Action Required: Form I-9 Document Inspection

The temporary flexibilities for Form I-9, Employment Eligibility Verification, ended on July 31, 2023.

Employers must update Tracker I-9 for all employees whose documents were inspected remotely during the temporary flexibility period (March 20, 2020, to July 31, 2023).

  • For active employees: Complete in-person physical document inspection and update the employee’s Section 2 Additional Information notes in Tracker I-9.
  • For terminated employees: Update the employee’s Section 2 Additional Information notes in Tracker I-9: “EMPLOYEE TERMINATED MM/DD/YYY, PRIOR TO THE IN-PERSON DOCUMENT INSPECTION.”   

The deadline to complete in-person inspection or report termination is August 30, 2023. Review our previous communication for detailed instructions and helpful resources.

Resuming In-Person Document Verification

Effective August 1, 2023, employment eligibility document verification completed for Form I-9 for new employees (both new hires and rehires) and work authorization reverification must be completed in person by either a department Tracker Processor or a designated Authorized Agent.

If you choose to use an Authorized Agent, you should continue to meet with them and the employee via teleconferencing software (e.g., Zoom) to resolve any issues and ensure the Authorized Agent inspects the correct documents.
