DHS Remote Document Inspection Policy Extended to January 31, 2021

U.S. Immigration and Customs Enforcement (ICE) today announced an extension of the remote document inspection policy related to Form I-9. The policy was set to expire and has now been extended to January 31, 2021. 

The announcement can be found on the USCIS website.

As a reminder, under this temporary policy, employers who are operating remotely:

  • Can receive and review employee documentation by video conference, email, or fax.
  • Must keep a record of all new hires for whom the physical inspection requirement has been deferred.
  • Must enter “COVID-19” as the reason for the delay of in-person inspection in Section 2 of each I-9.
  • Can open the Tracker website on an iPad or iPhone to capture an image of the documents and upload them in Tracker. Apple products allow the image of the document to be uploaded without maintaining a copy on the iPad, iPhone, or on iCloud.

  • Must complete physical inspections of all I-9 supporting documentation for remotely onboarded employees within three business days of resuming in-person operations.
